Entries will be accepted through some or all of the following methods, each constituting at least one, and maybe more additional entries, as set forth on the Sweepstakes page available at https://www.findkeep.love/products/nbpa-giveaway (and incorporated herein by reference):

A. By filling out a FindKeep.Love entry form whether hosted on the FindKeep.Love website or that of a Sponsor or other party, with your name, email address, zip code, gender, and any other information requested; and

B. Referring or sharing the Sweepstakes through various social media platforms.

 
Entrants are subject to all notices posted online including but not limited to these Official Rules and Consumer Disclosure and all Sponsors’ privacy policies, including those found at: https://nbpa.com/privacypolicy and https://www.findkeep.love/pages/privacy-policy.  

Before the End Date, FindKeep.Love may provide additional methods for entry. These Official Rules will be updated to indicate any such additional method of entry and will indicate the date on which this additional method began.

Released Parties (as defined below) are not responsible for late, lost, incomplete, inaccurate, illegible, mistyped, delayed, stolen, garbled or misdirected entries or entries not received for any reason (including technical failure), and any such entries are void.

To enter, you may also be required to verify that you are a human and not a machine through use of a challenge-response test (sometimes called a CAPTCHA) or similar mechanism.

2. ELIGIBILITY: These Sweepstakes are open only to legal residents of the United States of America who are 21 years old or older excluding residents of all United States Territories and Possessions. Void where prohibited by law. Entries will not be accepted from inmates in any correctional facility. Participation in these Sweepstakes constitutes full and unconditional agreement to these Official Rules and by the decisions of FindKeep.Love, which are final and binding on all matters pertaining to these Sweepstakes. The following individuals are not eligible: (a) employees, officers, and directors of the Sponsors, including all respective parent companies, subsidiaries, affiliates, partners, advertisers, marketing and promotion agencies, manufacturers or distributors of promotion materials, and representatives; and (b) members of the immediate family (parents, children, siblings, or spouses) of a person in (a) and/or those living in the same household as a person in (a), regardless of familial relation. All applicable federal, state and local laws and regulations apply. Entrants are prohibited from submitting an entry for a purpose other than entering these Sweepstakes for the entrant’s personal benefit. Prohibited purposes include, but are not limited to, engaging in competition with the Sponsors and luring emails to any fraud management tool such as a “spamtrap” or “honey pot.” Each entrant must use one and only one email account to enter. Any attempt to secure additional entries by using multiple email addresses will result in disqualification of all entries under all email addresses, in FindKeep.Love’s sole discretion. If any entry or entrant is determined to be non-compliant with these Official Rules, said entry or entrant shall be disqualified.

On or around each Drawing Date, FindKeep.Love will randomly select the identified number of potential winners for the corresponding Prizes from the eligible entries received for that Daily Entry Period. Decisions of FindKeep.Love are final and binding in all respects. FindKeep.Love will notify the potential winners by email. If by reason of a printing or other error, more Prizes are claimed for any Daily Entry Period than the number set forth in these Official Rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of Prizes available in the prize category in question. No more than the advertised number of Prizes will be awarded.

At the sole discretion of FindKeep.Love, disqualification, forfeiture, and the selection of an alternate winner may result from any of the following: (1) a potential winner’s failure to respond to winner notification within 72 hours of transmission; (2) the return of a notification as undeliverable; (3) a potential winner’s failure to provide FindKeep.Love with satisfactory proof of age, identity, and residency within seven (7) days of initial winner notification; (4) a potential winner’s failure to execute and return an affidavit of Eligibility and a Liability and Publicity Release (where legal) or requested tax information or W9 within three (3) days of its transmission; or (5) any other non-compliance with these Official Rules.

5. PRIZES (“Prizes”) and APPROXIMATE RETAIL VALUE (“ARV”):

ALL PRIZE CONDITIONS: Unless otherwise stated, no substitution or transfer of a Prize will be permitted, except that FindKeep.Love reserves the right to substitute a Prize of equal or greater value if the advertised Prize is unavailable. Prize cannot be transferred by winner. No Prize can be redeemed for cash or can be used for a prior purchase. Released Parties have no responsibility for cancellations, delays, or any other change by any company or person providing any element of the Prize due to reasons beyond their control, and are not responsible or liable for any expenses incurred as a consequence thereof. The Prize is awarded “as is” without warranty or guarantee of any kind, express or implied, without limitation. Winners shall be responsible for any and all federal, state, and local taxes as well as any other costs and expenses associated with Prize acceptance and use not specifically included in the Prize description as being provided. The Prize may be subject to terms imposed by the Sponsors or other Prize provider, including, but not limited to, prohibitions on selling the Prize, limiting the Prize’s for personal and not business use, and expiration dates. Any Sponsor or Prize supplier may require Winner and/or anyone receiving a direct benefit from the Prize (including but not limited to any travel companion) to sign a liability release and/or publicity license. Except where otherwise stated herein, all Prizes will be delivered free of charge (or in the case of electronic vouchers – emailed) to winners using the information submitted via the entry form. Winners acknowledge that the Released Parties do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the prize being offered, except that each merchandise Prize shall be subject to its manufacturer’s standard warranty (if any). Once the Prize has been delivered to the winner’s provided address or email address, the prize is considered awarded. FindKeep.Love may verify the information submitted by the winner during the Sweepstakes. All Prize details are at FindKeep.Love’s sole discretion. Actual value of autographed merchandise may vary depending on market fluctuations. Limit one (1) Prize per person for all Sweepstakes combined.

TRAVEL PRIZES: Prize package includes round trip, coach-class air transportation for two (2) from a major airport near winner’s home (determined by Sponsor in its sole discretion) to stated destination; and 2 nights' accommodations at a hotel determined by Sponsor in its sole discretion (one (1) room, double occupancy; room rate and room tax only). All travel arrangements will be made through Sponsors’ agent. Winner must travel on the dates determined by Sponsors in their sole discretion or prize will be forfeited. Trip must be booked at least twenty-one (21) days prior to departure. Travel and accommodations are subject to availability and blackout dates. Travel must be round trip. Sponsors will determine airline and flight itinerary in their sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Sponsors’ airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs associated with Prize acceptance and use not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, gratuities, baggage fees, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Guest must be twenty-one (21) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner. Guest must execute liability/publicity release prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. If in the judgment of Sponsors, air travel is not required due to winner’s proximity to prize location, ground transportation will be substituted for round trip air travel at Sponsors’ sole discretion and no compensation or substitution will be provided for difference in prize value. Sponsors will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Actual value may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value. Sponsors are not responsible if the applicable event is delayed, postponed or cancelled for any reason in which event that portion of prize is forfeited in its entirety, no substitution will be provided except as in Sponsors’ sole discretion, and winner will not be reimbursed for tickets. Terms of the tickets shall govern. Seating (if any) to be determined in the sole discretion of Sponsors. Tickets may be subject to standard rain-check policies and procedures. By accepting ticket prize, winner agrees to abide by any terms, conditions and restrictions provided by the ticket. Winner and guest agree to abide by all venue rules and regulations.  Failure to do may result in forfeiture of prize.

 

7. CONDITIONS OF PARTICIPATION

A. ELIGIBILITY. By participating in these Sweepstakes, all entrants represent and warrant that they are eligible to win and that they agree to be bound by these Official Rules and acknowledge understanding and acceptance of FindKeep.Love’s privacy policy, as amended from time to time, which can be read here: http://findkeep.love/privacy.

B. RELEASE AND PUBLICITY. By participating in these Sweepstakes all entrants agree to release, indemnify and hold harmless the Sponsors, and all affiliated individuals and entities as well as their successors and assigns, as well as all online platforms on which these Sweepstakes are advertised or on which notice of these Sweepstakes is posted, including, but not limited to Meta Platforms (dba Facebook and Instagram), X, TikTok, Inc., and Snapchat (collectively, the “Released Parties”), from and against any liability, injury, death, loss, or damages to entrant or any person or entity, including without limitation damage to personal or real property, caused in whole or in part, directly or indirectly, by reason of their participation in this Sweepstakes (or related activities) or their acceptance, possession or use/misuse of a Prize (including any travel or injury or harm related thereto) or participation in any Sweepstakes-related activity or participation in this Sweepstakes.

 

The Released Parties are not responsible for: any incorrect or inaccurate entry information; technical malfunctions; failures, omissions, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to your or any other computer or other device relating to or resulting from participation in this Sweepstakes; inability to access any website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entries that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the internet or at any website; technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by FindKeep.Love on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; printing, typographical, network, mechanical, human or other errors or problems relating to or in connection with the Sweepstakes, including, but not limited to, the administration of the Sweepstakes, the processing of entries, in the announcement of the Prizes, or in any Sweepstakes-related materials; and any entries which are late, lost, incomplete, misdirected, stolen, garbled, delayed or any combination thereof. Online submission is not considered proof of delivery or receipt.

 

Except where prohibited by law, the winner’s entry and acceptance of the Prize constitutes permission for Sponsors and their respective assigns to use said winner’s name, photographs, likeness, statements, biographical information, social media handles/user names (including by way of being tagged in a social media post), voices, hometown, and city and state addresses on a worldwide basis, and in all forms of media (now or hereafter known), in perpetuity, without further compensation, notification or authorization. In the event that the Winner resides in a jurisdiction that prohibits conditioning the receipt of a prize on consent to publicity, the Winner who resides in such a jurisdiction must notify FindKeep.Love of the intent to opt-out of publicity via email within five days of receipt of notification that the Winner won these Sweepstakes.  Winner agrees to participate in a testimonial video and/or interview (conducted in person or via video conferencing at FindKeep.Love’s sole discretion) that FindKeep.Love and/or the Sponsors can use at their discretion for trade or promotional purposes. Winner(s) further release and waive any right of or claim to copyright, trademark rights, privacy rights, publicity rights, rights to use of name, image or likeness, and any other legal or moral rights, relating to, arising out of, or embodied in the entry and/or arising out of the use of winner's name, image and likeness or information concerning the Winner(s). Winner(s) expressly agrees not to pursue, support, maintain, or authorize any action, claim, or dispute of any kind against the Released Parties on the grounds that any use of the entry, and/or the use of winner's name, image, or likeness violates or infringes any of winner’s rights, including, without limitation, copyrights, trademark rights, privacy, publicity and/or moral rights.

 

All entrants further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. You acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

 

THE RELEASED PARTIES ARE NOT RESPONSIBLE IF THIS SWEEPSTAKES CANNOT BE ADMINISTERED OR CONDUCTED OR ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS RESULTING OR ARISING FROM ACTS OF GOD, WAR, OR TERRORISM, CIVIL UNREST, STRIKES, SUPPLY SHORTAGES, NATURAL DISASTERS, WEATHER, EPIDEMICS, COMPLIANCE WITH ANY LAW OR ORDER OF A GOVERNMENTAL AUTHORITY, OR ANY OTHER SIMILAR ACT, EVENT, OR OCCURRENCE BEYOND THE REASONABLE CONTROL OF THE SPONSOR. BY PARTICIPATING IN THIS SWEEPSTAKES, PARTICIPANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THESE SWEEPSTAKES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE, AS APPLICABLE. FURTHER, SPONSOR SHALL NOT BE RESPONSIBLE FOR ANY CANCELLATIONS, DELAYS, DIVERSIONS, CHANGES IN SERVICE OR ACCOMMODATIONS OR SUBSTITUTIONS, OR FOR ANY ACTS OR OMISSIONS BY ANY THIRD PARTIES BEYOND ITS REASONABLE CONTROL, INCLUDING AIR CARRIER(S) AND OTHER TRANSPORTATION COMPANIES; LODGING, RESTAURANT OR OTHER HOSPITALITY PROVIDERS; ENTERTAINMENT PROVIDERS, VENUES OR ARTISTS; OR OTHER THIRD PARTY PROVIDERS SUPPLYING ANY SERVICES OR COMPONENTS OF THE PRIZE(S) TO WINNERS AND/OR THEIR TRAVEL COMPANIONS, OR FOR ANY RESULTING INJURIES, INCLUDING MONEY DAMAGES, COSTS AND EXPENSES, PROPERTY DAMAGES, PERSONAL INJURIES OR DEATH RESULTING THEREFROM.

C. As a condition of entering these Sweepstakes, each entrant gives consent for Sponsors to obtain and deliver his or her name, address and other information to third parties, including FindKeep.Love, for the purpose of administering these Sweepstakes and to comply with applicable laws, regulations and rules, including, without limitation, the storing of your personal information for purposes of complying with state record retention requirements. Any information entrant provides to Sponsor may be used to communicate with entrant in relation to these Sweepstakes or on a Sweepstakes winner’s list.

D. ADVERTISING AND SOLICITATION. By entering this Sweepstakes, you consent to receiving emails, special offers, electronic newsletters, and solicitations from the Sponsors, and third-party vendors that may constitute requests to engage in a monetary transaction. Each email will provide you the ability to opt out of future communication from the applicable sender. If you would prefer to opt out now, please email support@findkeep.love. If you do not want FindKeep.Love to share your information with third parties, please email support@findkeep.love. In some cases, your information may be shared before FindKeep.Love receives and processes your opt-out. In such a situation, you will need to request removal from the email list of the entity or entities with which FindKeep.Love has shared your information. Opting out of emails and offers will not impact your chance of winning in these Sweepstakes.

E. DISCLOSURE OF INFORMATION. By participating in these Sweepstakes, you hereby agree to FindKeep.Love’s and the Sponsors’ collection, use, and dissemination of your personal information as set forth in Sponsors’ privacy policies at: https://nbpa.com/privacypolicy and https://www.findkeep.love/pages/privacy-policy..

F. ENTRY ERRORS/INTERNET. If for any reason a Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of FindKeep.Love which corrupt or affect the administration, security, fairness, integrity, or proper conduct of a Sweepstakes, FindKeep.Love reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner, and to cancel, terminate, modify or suspend the Sweepstakes. In such a situation, FindKeep.Love reserves the right to select winner(s) for the Sweepstakes at issue from non-suspect, eligible entries received for such Sweepstakes as of the termination date or as otherwise deemed fair and appropriate by FindKeep.Love. Without limiting the foregoing, FindKeep.Love may reject any entrant, if in FindKeep.Love's sole judgment, the entrant has been disqualified, has questionable eligibility, or is otherwise ineligible to enter or participate. CAUTION: A PERSON WHO ATTEMPTS TO UNDERMINE THE LEGITIMATE OPERATION OF THESE SWEEPSTAKES MAY BE SUBJECT TO CIVIL AND/OR CRIMINAL PENALTIES AND FINES; AND FINDKEEP.LOVE RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. If there is a dispute as to the identity of the entrant, the Prize will be awarded to the authorized account holder of the email address. The “authorized account holder” is defined as the natural person to whom the email address is assigned by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

 

G. NON-COMPETITION AND NON-SOLICITATION. By entering this Sweepstakes, you agree on your own behalf and on behalf of any company or entity for which you are an employee, officer, director, manager, or member or for which you hold any other formal position not to: solicit the Sponsors; engage in the provision of online marketing services to the Sponsors; and/or run, coordinate, or otherwise execute online sweepstakes. This restriction shall last for one-year from the End Date.

Failure to comply with any requirement listed herein, as determined in FindKeep.Love’s sole judgment, may result in removal from the Sweepstakes and/or forfeiture of the Prize after which an alternate winner may be selected.

8. GOVERNING LAW: In the event of a dispute between you and Sponsors, either may choose to resolve the dispute by binding arbitration, as described below, instead of in court. Any claim (except for a claim challenging the validity or enforceability of this arbitration agreement, including the Class Action Waiver) may be resolved by binding arbitration if either side requests it. THIS MEANS IF EITHER YOU OR SPONSORS CHOOSES ARBITRATION, NEITHER PARTY SHALL HAVE THE RIGHT TO LITIGATE SUCH CLAIM IN COURT OR TO HAVE A JURY TRIAL. DISCOVERY AND APPEAL RIGHTS ARE LIMITED IN ARBITRATION. This arbitration agreement is governed by the Federal Arbitration Act. Any arbitration will take place in California within one hundred miles of San Jose, California by a single arbitrator, and will be conducted by the American Arbitration Association or JAMS pursuant to the rules of the body conducting the arbitration. ARBITRATION AND/OR ANY COURT ACTION MUST BE ON AN INDIVIDUAL BASIS. THIS MEANS NEITHER YOU NOR SPONSORS MAY JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION OR COURT BY OR AGAINST OTHER PERSON OR ENTITY, OR LITIGATE IN COURT OR ARBITRATE ANY CLAIMS AS A REPRESENTATIVE OR MEMBER OF A CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. Only a court, and not an arbitrator, shall determine the validity and effect of the Class Action Waiver. Even if all parties have opted to litigate a claim in court, you or Sponsors may elect arbitration with respect to any claim made by a new party or any new claims later asserted in that lawsuit. Sponsors will not choose to arbitrate any claim you bring in small claims court. However, if such a claim is transferred, removed, or appealed to a different court, Sponsors may then choose to arbitrate and you agree that in so doing, Sponsors will not have waived any rights. Any action brought in a court against Sponsors shall be brought in the State Courts of California in Santa Clara County or in the federal court in the Northern District of California and you and Sponsors both agree to be subject to personal jurisdiction in the State of California. Except where otherwise indicated, the laws of the United States and California govern this contract. Notwithstanding the foregoing, either party may pursue injunctive or other equitable remedies in the above-identified courts and such claims shall not be subject to arbitration. Any and all claims, judgments and awards will be limited to actual third-party, out-of-pocket costs incurred (if any) not to exceed ten dollars ($10.00), but in no event will attorneys’ fees be awarded or recoverable; (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to seek, punitive, incidental, consequential or special damages, lost profits and/or any other damages, other than actual out of pocket expenses not to exceed ten dollars ($10.00), and/or any rights to have damages multiplied or otherwise increased; and (d) entrants’ remedies are limited to a claim for money damages (if any) and entrant irrevocably waives any right to seek injunctive or equitable relief. Some jurisdictions do not allow the limitations or exclusion of liability, so the above may not apply to you.

9. SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

10. WINNERS LIST: A copy of the winners list for these Sweepstakes may be obtained by sending a written request to FindKeep.Love, at PO Box 33006, Los Gatos, CA 95031 postmarked within 15 calendar days of the End Date or by emailing support@findkeep.lovewithin 15 calendar days of the End Date. Any such request must identify the Sweepstakes by name as well as the drawing date for the Daily Entry Period. FindKeep.Love will respond by mail or email within thirty days of receipt of the request.

11. MISCELLANEOUS:

A. UPDATES: FindKeep.Love reserves the right to update or modify these rules at any time with or without notice by posting updated rules at https://www.findkeep.love/pages/nbpa-giveaway-terms-conditions.

B. CANCELATION: FindKeep.Love reserves the right to cancel any of these Sweepstakes at any time for any reason.

C. THIRD-PARTY FEES: You may be charged for visiting the Sweepstakes website in accordance with the terms of your service agreement with your internet or mobile telephone carrier. Please consult your provider regarding your pricing plan. You must use a Smartphone device to participate via your mobile phone. Not all mobile phone providers carry the necessary service to participate. Check your phone capabilities for specific Internet instructions. If your data usage exceeds what is allotted by your data plan, you could be subject to additional fees by your carrier. Please contact your provider with any questions regarding your bill.

D. TAX REPORTING: If the retail value of any winner's prize is $600 or more, or any winner wins prizes which are cumulatively valued at over $600 in the course of a single year, the winner must complete a W9 form and supply FindKeep.Love with his/her social security number for tax purposes. An IRS Form 1099-NEC and/or any other applicable tax form will be issued in the name of the winner for the actual value of the prizes received.

E. COPY OF OFFICIAL RULES. To a printed copy of these Official Rules, send a written request by the Sweepstakes End Date to FindKeep.Love, at PO Box 186, Los Gatos, CA 95031. Any such request must identify the Sweepstakes by name.

F. These Sweepstakes are not sponsored by and is in no way endorsed by, administered by, and/or associated with any social media network on which notice of these Sweepstakes are posted, including, but not limited to Facebook, X, Snapchat, and Instagram. Moreover, no Sponsor, by virtue of sponsoring these Sweepstakes, endorses any other Sponsor of these Sweepstakes. Unless otherwise stated herein, no manufacturer or distributor of any Prize identified herein, by virtue of being such a manufacturer or distributor, is a Sponsor of these Sweepstakes or in any way sponsors, endorses, administers, or is associated with these Sweepstakes or FindKeep.Love.
